The Service is operated by Bookmark ("Bookmark", "we", "our", or "us").By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.EligibilityYou must be at least 13 years of age to use the Service. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.By using the Service, you represent and warrant that you meet these eligibility requirements.Your AccountCertain features of the App require you to create an account using Sign in with Apple. By creating an account, you agree to:Provide accurate information when setting up your profile
Keep your account secure and not share access with others
Accept responsibility for all activity that occurs under your account
Notify us promptly if you believe your account has been compromisedYou may use the App's core features (book tracking, reading progress, goals, and streaks) without creating an account. An account is required for social features, book clubs, and feature requests.We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.Free and Premium FeaturesBookmark offers both free and premium tiers.Free Tier:
The free tier includes core book tracking features with a limit of 50 books (library and wish list combined). Feature availability in the free tier may change over time.Premium Subscription (Bookmark Pro):
Premium subscriptions unlock additional features including unlimited books, reading goals, preorder tracking, book subscriptions, and advanced statistics. Premium is available as monthly, annual, or lifetime purchases.Subscriptions are processed and managed entirely by Apple through the App Store. By purchasing a subscription, you also agree to Apple's terms and conditions for in-app purchases.Subscription payments are charged to your Apple ID account. Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID settings.We do not process payments directly and do not have access to your payment information. Refund requests must be directed to Apple through their standard refund process.We reserve the right to change subscription pricing. Any price changes will apply to billing periods that begin after the change takes effect. Existing subscribers will be notified of price changes in accordance with App Store policies.Features included in the free and premium tiers may be modified at any time. We may add features to the free tier or move features between tiers. We will endeavour to provide reasonable notice of material changes to premium features.Acceptable UseYou agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:Use the Service in any way that violates applicable local, state, national, or international law or regulation
Impersonate any person or entity, or falsely represent your affiliation with any person or entity
Harass, abuse, threaten, bully, or intimidate other users
Post or transmit content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable
Post or transmit spam, unsolicited promotions, or repetitive content
Attempt to gain unauthorised access to the Service, other user accounts, or any systems or networks connected to the Service
Interfere with or disrupt the Service or servers or networks connected to the Service
Use automated means (bots, scrapers, or similar tools) to access or interact with the Service
Collect or harvest information about other users without their consent
Circumvent, disable, or otherwise interfere with any security or access-control features of the Service
Use the Service to distribute malware, viruses, or other harmful code
Exploit any bugs, vulnerabilities, or unintended features of the Service
Create multiple accounts to evade bans, restrictions, or usage limits
Use the Service for any commercial purpose without our prior written consentUser-Generated ContentThe Service allows you to create and share content including but not limited to social profile information, usernames, display names, profile photos, activity feed posts, comments, book club discussions and messages, feature request submissions, and book ratings ("User Content").Ownership:
You retain ownership of the User Content you create. By posting User Content through the Service, you grant Bookmark a worldwide, non-exclusive, royalty-free, transferable licence to use, display, reproduce, distribute, and store your User Content solely for the purposes of operating and providing the Service. This licence ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it, or where retention is required by law.Responsibility:
You are solely responsible for all User Content you post or share through the Service. You represent and warrant that:You own or have the necessary rights and permissions to post your User Content
Your User Content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, or other rights
Your User Content complies with these Terms and all applicable lawsNo Obligation to Monitor:
We are not obligated to monitor, review, or edit User Content. However, we reserve the right to remove, disable, or restrict access to any User Content at any time and for any reason, including content that we believe violates these Terms, without prior notice.No Endorsement:
User Content does not represent the views or opinions of Bookmark. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.Social Features and Community GuidelinesThe Service includes optional social features such as user profiles, following other users, activity feeds, likes, comments, and book clubs.Profile Visibility:
You can set your profile to public or private. A public profile allows any user to view your profile information and follow you. A private profile requires your approval before another user can follow you. Regardless of your privacy setting, your username and display name may be visible to other users in search results.Following and Blocking:
You may follow other users, and other users may follow you (subject to your privacy settings). You may block or mute any user at any time. Blocking a user will remove all follow relationships between you and that user, remove cross-likes on activity, and prevent future follows. Muting a user will hide their activity from your feed without affecting follow relationships.Book Clubs:
Book clubs are user-created groups. Club creators and administrators are responsible for managing their clubs. Bookmark does not moderate individual book clubs but reserves the right to remove clubs or club content that violates these Terms.Comments and Discussions:
You may post comments on activity feed posts and messages in book club discussions. All comments and messages must comply with the Acceptable Use section of these Terms. We reserve the right to remove any comment or message that violates these Terms.Reporting and Moderation:
We reserve the right (but are not obligated) to investigate and take action against violations of these Terms, including removing content, suspending or terminating accounts, and reporting illegal activity to law enforcement.Book Metadata and Third-Party ContentThe App displays book information including titles, authors, descriptions, cover images, page counts, and publication dates sourced from third-party services (including ISBNdb via our API proxy).This information is provided for convenience only. We do not guarantee the accuracy, completeness, timeliness, or availability of any third-party content. We are not responsible for errors, omissions, or inaccuracies in book metadata.Book cover images and metadata are the property of their respective rights holders. Their display within the App does not imply any endorsement by or affiliation with Bookmark.Data ImportThe App allows you to import reading data from third-party services such as Goodreads (via CSV export). Imported data is processed entirely on your device. You are responsible for ensuring you have the right to use and import any data you provide. We are not responsible for the accuracy or completeness of imported data.Currency and Pricing InformationThe App may display currency conversion rates sourced from third-party providers (Open Exchange Rates via our API proxy) to assist with tracking book purchase prices. Exchange rates are provided for informational purposes only and may not reflect real-time market rates. We do not guarantee the accuracy of currency data and are not responsible for any decisions made based on this information.NotificationsThe App may request your permission to send local notifications for reading reminders, streak alerts, goal achievements, preorder release dates, subscription renewal reminders, social activity, and book club deadlines. You can manage notification preferences within the App's settings or through your device settings at any time.WidgetsThe App offers home screen widgets that display reading progress, streaks, and preorder information. Widgets access data stored locally on your device and do not transmit data over the internet.Intellectual PropertyThe Service, including its design, code, user interface, branding, logos, trademarks, and all related materials, is owned by Bookmark and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.You may not:Copy, modify, adapt, translate, or create derivative works of the Service or any part thereof
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Use the Bookmark name, logo, or branding for any purpose without our prior written consent
Frame, mirror, or otherwise incorporate any part of the Service into another product or serviceAll rights not expressly granted to you in these Terms are reserved by Bookmark.PrivacyYour privacy is important to us. Our use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.Third-Party ServicesThe Service integrates with and relies on certain third-party services, including Apple (Sign in with Apple, App Store, StoreKit), Supabase (authentication and data storage for social features), TelemetryDeck (privacy-focused analytics), Cloudflare Workers (API proxy), ISBNdb (book metadata), and Open Exchange Rates (currency data).Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service. ANY INFORMATION PROVIDED THROUGH THE SERVICE (INCLUDING BOOK METADATA, CURRENCY CONVERSION RATES, AND READING STATISTICS) IS FOR INFORMATIONAL AND PERSONAL USE ONLY.Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOOKMARK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:Your access to or use of (or inability to access or use) the Service

Any interruption, suspension, or termination of the ServiceTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOKMARK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO BOOKMARK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100).SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. You may stop using the Service at any time by deleting the App from your device. If you have an account, you may delete your social profile and all associated data within the App's settings.By Us:
We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including but not limited to violation of these Terms. We may also remove any User Content at our discretion.Effect of Termination:
Upon termination, your right to use the Service ceases immediately. The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and any other provisions that by their nature should survive.We are not liable to you or any third party for any termination of your access to the Service.Governing Law and Dispute ResolutionThese Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law provisio
