Terms of Service — BookmarkLast Updated: 10 May 2026These Terms of Service ("Terms") govern your access to and use of the Bookmark mobile application (the "App"), the website at https://bookmarkapp.com.au, and any related services (collectively, the "Service"). The Service is operated by Bookmark ("Bookmark", "we", "our", or "us").By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.EligibilityYou must be at least 13 years of age to use the Service. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.By using the Service, you represent and warrant that you meet these eligibility requirements.Your AccountCertain features of the App require you to create an account using Sign in with Apple or other supported authentication providers.By creating an account, you agree to:- Provide accurate and complete information
- Keep your account credentials secure
- Be responsible for all activity conducted through your account
- Notify us immediately if you suspect unauthorised access to your accountBookmark may store and synchronise your account data, reading activity, preferences, imports, social content, and related information using cloud infrastructure operated by Bookmark and its service providers.Some features of the Service may require an internet connection and an active account, including cloud sync, social features, backups, cross-device access, and account recovery.We reserve the right to suspend or terminate accounts that violate these Terms.Free and Premium FeaturesBookmark offers both free and premium subscription tiers.Free TierThe free tier includes core book tracking functionality with limits that may change over time.Premium Subscription (Bookmark Pro)Premium subscriptions unlock additional features, including unlimited books, advanced statistics, preorder tracking, reading goals, and subscription management tools.Subscriptions are processed and managed through Apple App Store and/or Google Play, depending on your device platform. By purchasing a subscription, you also agree to the applicable platform provider's billing terms and conditions.Subscription payments are charged to your Apple ID account or Google Play account depending on the platform used for purchase.Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.You may manage or cancel subscriptions through your Apple App Store or Google Play account settings.Refund requests must generally be directed to the relevant platform provider unless otherwise required by applicable law.We reserve the right to modify subscription pricing and features at any time in accordance with applicable law and platform requirements.Acceptable UseYou agree not to:- Violate any applicable law or regulation
- Impersonate another person or entity
- Harass, threaten, abuse, or intimidate other users
- Upload unlawful, defamatory, hateful, obscene, or infringing content
- Attempt to gain unauthorised access to systems or accounts
- Use bots, scrapers, or automated systems to access the Service
- Interfere with the operation or security of the Service
- Distribute malware or harmful code
- Exploit bugs or vulnerabilities
- Circumvent security protections or usage restrictions
- Use the Service for unauthorised commercial purposesUser ContentThe Service may allow you to create, upload, or share content including usernames, profile information, book reviews, comments, posts, club discussions, feature requests, ratings, and other content ("User Content").OwnershipYou retain ownership of your User Content. By posting User Content through the Service, you grant Bookmark a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, and use that content solely for the purpose of operating and improving the Service.ResponsibilityYou are solely responsible for your User Content and represent that:- You own or have permission to use the content
- The content does not infringe the rights of any third party
- The content complies with these Terms and applicable lawsModerationWe reserve the right, but are not obligated, to review, remove, restrict, or disable User Content that we believe violates these Terms or may expose us or other users to harm or liability.Social FeaturesBookmark may include optional social features including profiles, follows, comments, activity feeds, clubs, reactions, and messaging features.You may block or mute other users at any time using available tools within the App.We reserve the right to investigate misuse of social features and take appropriate moderation action, including content removal, suspensions, or account termination.Book Metadata and Third-Party ContentThe Service may display book metadata including titles, authors, descriptions, cover images, release dates, and pricing information sourced from third-party providers including ISBNdb and other metadata services.This information is provided for convenience only. We do not guarantee the accuracy, completeness, or availability of third-party content.All trademarks, cover art, and intellectual property remain the property of their respective owners.Data ImportThe App may allow you to import data from third-party services and files including Goodreads CSV exports and spreadsheet imports.Imported data may be processed, transmitted, and stored on Bookmark's servers and cloud infrastructure to enable syncing, backups, analytics, account continuity, and cross-device functionality.You are responsible for ensuring you have the necessary rights to import any data you provide.Cloud Sync and Data StorageBookmark may store and synchronise your data using cloud infrastructure and third-party service providers.You acknowledge and agree that:- Data transmitted over the internet may not always be secure
- Temporary outages, delays, corruption, or loss of data may occur
- Deleted data may persist temporarily in backups or cached systems
- Certain data may be retained where required for legal, security, fraud prevention, or operational purposesWhile we implement reasonable safeguards, we do not guarantee uninterrupted or error-free cloud services.Notifications and WidgetsThe App may provide notifications for reminders, goals, streaks, preorders, subscriptions, social activity, and other features.The App may also provide widgets that access locally stored and synchronised account data.You may manage notification permissions through your device settings.PrivacyYour use of the Service is also governed by our Privacy Policy available at https://bookmarkapp.com.au/privacy.By using the Service, you consent to the collection, storage, processing, transmission, and use of your information as described in the Privacy Policy, including the storage and synchronisation of data using cloud infrastructure and third-party providers.Third-Party ServicesThe Service may integrate with third-party services including Apple, Google Play, Supabase, Cloudflare, TelemetryDeck, ISBNdb, Open Exchange Rates, and other providers.We are not responsible for the availability, security, accuracy, or practices of third-party services.Your use of third-party services may also be subject to their own terms and privacy policies.Intellectual PropertyThe Service, including its software, branding, design, text, graphics, and other materials, is owned by Bookmark and protected by intellectual property laws.You may not:- Copy, reproduce, modify, or distribute the Service
- Reverse engineer or decompile the App
- Remove proprietary notices
- Use Bookmark branding without written permissionAll rights not expressly granted are reserved.Disclaimer of WarrantiesTHE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKMARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.WE DO NOT WARRANT THAT:- The Service will be uninterrupted or error-free
- The Service will always be secure or available
- Data loss will not occur
- Defects or errors will be corrected
- Third-party content will be accurate or availableUse of the Service is at your own risk.Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKMARK AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.THIS INCLUDES LOSS OF PROFITS, DATA, GOODWILL, BUSINESS INTERRUPTION, DEVICE FAILURE, OR OTHER INTANGIBLE LOSSES.BOOKMARK'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:(A) THE AMOUNT YOU PAID TO BOOKMARK IN THE PRECEDING 12 MONTHS; OR
(B) AUD $100.Nothing in these Terms excludes rights that cannot be excluded under applicable law, including rights under the Australian Consumer Law.IndemnificationYou agree to indemnify and hold harmless Bookmark, its affiliates, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses arising out of:- Your use of the Service
- Your User Content
- Your breach of these Terms
- Your violation of applicable laws or third-party rightsTerminationBy YouYou may stop using the Service at any time by uninstalling the App and deleting your account where applicable.By UsWe may suspend or terminate access to the Service at any time if we reasonably believe you have violated these Terms or where necessary to protect the Service, users, or third parties.Effect of TerminationUpon termination, your right to use the Service ceases immediately. Certain sections of these Terms will survive termination, including intellectual property, disclaimers, limitations of liability, indemnities, and dispute resolution provisions.Governing LawThese Terms are governed by the laws of Queensland, Australia.You agree that any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.Changes to These TermsWe may update these Terms from time to time.Where required by law, we will provide notice of material changes.
